Abstract

Dr. B.R. Ambedkar, in his third reading of the constitution of Indian Republic said, " Indians should make the political democracy a social democracy as well. They must overcome the difficulties of social and economical inequalities and recognize the principle of fraternity if they wished to become a nation in reality." Human rights violations are the offshoot of social and economical inequality that exist in our society and that is the biggest challenge in this century. Its worst form is the violation of child labour rights. There is no universally accepted definition of child labour, it varies. Child labour can be defined as the activity children perform (objectionable), which exploits them mentally, psychologically, physically. According to social scientists child work is always objectionable, for example if a child helps in a tea shop in support of the owner, then it is not child labour, but if in case, the same child is not paid or has been forced by the owner to do hectic task, then the child becomes a labour. The moment the activity leads to the violation of the rights of the child or exploitation of the child resources then it becomes rigidly objectionable. According to United Nation's convention, ‘child labour ’means all the activities regarding soldiering and prostitution.where prostitution can never be considered child labour because of the illegality in the sources and the child has no option to choose. Child labour varies under different enactments. Census India, in 2001 reports that 1, 85, 595 children employed in domestic help in small road side eateries
