Abstract

Arbitration as an optional private, informal, quick and, more importantly, flexible mechanism for settling disputes takes place within a complex and vitally important international legal framework. But unfortunately, there is no certain view and consensus on the meaning of the word of arbitration in the legal communities. Whilst there is no universal accepted comprehensive meaning of arbitration, there is a general consensus about the characteristics or main features of arbitration. The primary object of this descriptive study seeks to understand two main questions; 1) what is the conceptual formwork of arbitration? And, 2) what is the characteristics or main features of arbitration?
